Terms & Conditions for Classes and Courses with Clear Water Academy
1. Eligibility of Enrolment
i. We welcome students of all backgrounds and ages provided they have the interest and ability to learn.
ii. Students under the age of 16 must be accompanied by an adult. The accompanying adult must purchase a place on the given course or class on behalf of the child (and themselves if they also wish to take part in the course) and be present in the building for the duration of each class the child attends.
iii. Students who appear under the age of 18 must provide proof of identity and will be turned away and without refund for purchased classes if they are found or suspected to be under 16 without an accompanying adult.
2. Means and confirmation of enrolment
i. For languages, decide which language to study, and using the language descriptions and level indicators, decide the appropriate course for you.
ii. To enrol for a given course via our website, select the course and difficulty on the given course's page on our website, www.clearwateracademy.net. Purchase and secure your place on the course via the Paypal 'Buy Now' button. Login and follow the instructions. Clicking 'Pay Now' confirms your payment and constitutes acceptance of enrolment. Classes can also be purchased via online bank transfer when class level, duration and prices have been agreed. Payment and receipt of confirmation of payment from us constituted acceptance of enrolment.
iii. Acceptance of enrolment, evidenced by confirmation of the student’s booking, will constitute a legally binding agreement.
2.1. Loans and Returns for Japanese Course Textbooks and CDs
i. As of August 2017, students enrolling on our Japanese courses have the choice of loaning the course textbook and CD for £5 per term of classes while studying with us or purchasing the course textbook and CD new at the start of term for £16. By accepting enrolment on a Japanese course and signing the 'Course Textbook and CD Loan Agreement' provided before the first class, the student agrees to pay £5 at the start of term for loaning a course textbook and its accompanying CD, returning the same course textbook and CD at the end of, or toward the end of, the 10-week term (either in person or through a representative on weeks 9 or 10). By accepting enrolment on a Japanese course and signing the 'Course Textbook and CD Loan Agreement students agree to pay for the full cost of the textbook (£16), in the event that the book and/or its accompanying CD is unreasonably damaged (e.g. pages or covers torn, pages marked with stains, pages missing, text made illegible, CD scratched) or beyond further use, which will be determined by the teacher or Clear Water Academy staff upon return of the textbook and CD. Students enrolled on a Japanese course who fail to return loaned course textbook(s) and CD(s) or who refuse to pay the full cost of unreasonably or irreparably damaged textbooks and/or CDs will be prosecuted.
3.1. Cancellations and Refunds Policy: Cancellations by the School
i. Clear Water Academy reserves the right to cancel any course which does not recruit a viable number of students. A full refund will be made in these circumstances.
3.2. Cancellations and Refunds Policy: The 14-day 'Cooling Off' Period
i. If the student has booked a course via our website (a ‘distance contract’), they are entitled to a 14-day ‘cooling off’ period. During this ‘cooling-off’ period the student may cancel their booking for any reason within 14 days and receive a refund of all fees. Students must provide written confirmation of their wish to cancel their booking to Clear Water Academy via the email address email@example.com. If the student cancels during the ‘cooling off’ period described above, Clear Water Academy will refund the fees within 14 days of the date that the student informs the school that they wish to cancel. However, if the student has requested Clear Water Academy provide services during the cooling off period, the school is entitled to charge a reasonable sum for the services. By purchasing and confirming enrolment on a course(s) which commences within the 'cooling off' period, the student gives their express confirmation that they wish to be provided with services and that Clear Water Academy reserves the right to charge a reasonable sum for services provided if the student cancels the course(s). This sum will be based on the proportion of the course the student has undertaken and the overall cost of the course. Clear Water Academy can deduct this sum from any refund payable.
3.3. Cancellations and Refunds Policy: Outside the 'Cooling Off' Period
i. The student may cancel their programme for whatever reason, but if the cancellation is outside the ‘cooling off’ period as described in 4.2.i, or if a ‘cooling off’ period does not apply, they will be liable for the following proportion of the total tuition fees:
• 7-14 days before the start of the course – 50% of the enrolment fee plus an administration charge.
• Less than 7 days before the start of the course – 75% of the enrolment fee plus an administration charge.
• No refunds are given once the course has started except in exceptional circumstances and agreed upon by the student and Clear Water Academy management.
4. Lost and Stolen Property
i. Clear Water Academy does not accept responsibility for loss of personal belongings left unattended at our venues. By enrolling for a course, students take personal responsibility for any and all personal artefacts left at our venues.
